Executor & Administrator Disputes

Executors who won't act, won't account or won't agree. We act for beneficiaries who need an estate moved along — and for executors who need to be protected while they do a difficult job.

Confidential and free to use. Ai Guy® gives you a plain-English starting point and connects you with a solicitor. It is not legal advice.

Typical matters we cover

  • Removing or replacing executors

    Applications under s.50 AJA 1985 and s.116 SCA 1981.

  • Accounts & information

Compelling an executor to provide an inventory and account of the estate.

  • Delay & maladministration

Estates that have stalled, assets sold below value, or beneficiaries kept in the dark.

  • Executor liability

Protecting personal representatives who act properly; claims against those who don't.

  • Deadlocked co-executors

Breaking the deadlock without derailing the administration.

  • Trustee disputes

The same principles applied to lifetime and will trusts.

Common questions

Frequently asked questions

Yes. The court can remove or substitute a personal representative under section 50 of the Administration of Justice Act 1985 where it is in the interests of the beneficiaries as a whole — for example, serious delay, conflict of interest, misconduct or complete breakdown of relations. It's a last resort; a firm letter often does the job.
