Common questions

Frequently asked questions

Under Part II of the Landlord and Tenant Act 1954, a business tenant in occupation has a statutory right to renew the lease at the end of the term unless the landlord can establish one of the limited grounds for opposing it. The parties can agree to exclude that right ('contract out') before the lease is granted — a decision that affects the value of the lease to both sides.
